Terms of Service & End User License Agreement
Effective Date: March 7, 2026
Please read this End User License Agreement and Terms of Service (“Agreement”) carefully before using FilmFriend (“the Service”, “Platform”, “we”, “us”, or “our”). By creating an account, clicking “I Agree,” or otherwise accessing or using the Service, you agree to be bound by this Agreement. If you do not agree to these terms, you may not access or use the Service.
1. Acceptance of Terms
By registering for or using FilmFriend, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), that you have read and understood this Agreement, and that you agree to be legally bound by it. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to this Agreement.
2. Description of Service
FilmFriend is a cloud-based platform that provides professional film production and screenwriting tools, including but not limited to: script editing, scene breakdown, shot list generation, character analysis, crew and cast management, production scheduling, call sheet generation, storyboard generation, and AI-assisted contract drafting (collectively, the “Service”). The Service incorporates artificial intelligence features powered by third-party AI providers.
3. License Grant
Subject to your compliance with this Agreement and payment of any applicable fees, FilmFriend grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal or internal business purposes. This license does not include the right to sublicense, resell, or commercially distribute the Service or its outputs to third parties.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at legal@filmfriend.app if you become aware of any unauthorized use of your account. We reserve the right to disable accounts that violate this Agreement.
5. AI-Generated Content
5.1 Nature of AI Output
The Service uses artificial intelligence to generate content including scripts, scene breakdowns, character analyses, contracts, storyboards, and other production materials (“AI-Generated Content”). AI-Generated Content is produced algorithmically and may contain errors, inaccuracies, or content that requires professional review.
5.2 Not Professional Legal or Financial Advice
AI-generated contracts, deal memos, and agreements produced by the Service are drafts intended as starting points only. They do not constitute legal advice and are not a substitute for review by a qualified attorney. FilmFriend is not a law firm and does not provide legal services. You are solely responsible for any contracts you execute.
5.3 Ownership of Output
To the extent permissible by law, AI-Generated Content produced from your input data is assigned to you. You represent that any content you submit to generate AI output does not infringe the intellectual property rights of any third party.
5.4 Usage Limits
AI features are subject to monthly usage limits based on your subscription plan. Limits reset at the start of each calendar month (UTC). Unused generations do not roll over. We reserve the right to adjust plan limits with reasonable notice.
6. User Content
You retain ownership of scripts, files, and other content you upload or create through the Service (“User Content”). By uploading User Content, you grant FilmFriend a limited, non-exclusive, royalty-free license to process and store your User Content solely to provide and improve the Service. We will not share, sell, or use your User Content for AI training without your explicit consent.
7. Prohibited Uses
You agree not to:
- Use the Service to generate content that is unlawful, harmful, defamatory, obscene, or infringing;
- Attempt to circumvent, disable, or reverse-engineer any security or usage-limiting features;
- Use automated scripts, bots, or other means to make API calls beyond your allotted plan limits;
- Resell or sublicense access to the Service or its AI features to third parties;
- Use the Service to train competing AI models or products;
- Upload malicious code, malware, or content designed to disrupt the Service;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity;
- Violate any applicable local, state, national, or international law or regulation.
8. Subscriptions and Billing
Access to certain features requires a paid subscription plan. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. We reserve the right to change pricing with at least 30 days' notice. Failure to pay may result in suspension or termination of your account.
9. Intellectual Property
The Service, its design, code, trademarks, and all content provided by FilmFriend (excluding User Content and AI-Generated Content assigned to you) are and remain the exclusive property ofFilmFriend and its licensors. Nothing in this Agreement grants you any right to use our trademarks, logos, or brand identifiers without prior written consent.
10. Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated into this Agreement by reference. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. We implement industry-standard security measures to protect your data, but no method of transmission or storage is 100% secure.
11. Third-Party Services
The Service integrates with third-party services including Anthropic (AI processing), Supabase (database and authentication), and open weather APIs. Your use of those services is subject to their respective terms and privacy policies. FilmFriend is not responsible for the acts or omissions of third-party service providers.
12. Disclaimer of Warranties
The service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. AI-generated content is provided without warranty of accuracy, completeness, or fitness for any particular legal or commercial purpose.
13. Limitation of Liability
To the maximum extent permitted by applicable law, FilmFriend and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from this agreement shall not exceed the greater of (a) the fees paid by you in the three months preceding the claim or (b) one hundred US dollars ($100).
14. Indemnification
You agree to defend, indemnify, and hold harmless FilmFriend and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of this Agreement; or (d) your violation of any rights of a third party.
15. Term and Termination
This Agreement is effective until terminated. We may suspend or terminate your account at any time for violation of this Agreement, with or without notice. Upon termination, your license to use the Service ceases immediately. Sections 5.2, 9, 12, 13, 14, and 17 survive termination.
16. Modifications
We reserve the right to modify this Agreement at any time. We will notify you of material changes by posting the updated Agreement on this page and updating the Effective Date above, or by email. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Agreement.
17. Governing Law and Disputes
This Agreement is governed by the laws of the State of California, United States, without regard to conflict of law principles. Any dispute arising from this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
18. General
This Agreement constitutes the entire agreement between you and FilmFriend with respect to the Service. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any provision does not constitute a waiver of that provision. You may not assign this Agreement without our written consent; we may assign it freely.
